Terms of Service
1. Agreement to Terms
By downloading, installing, accessing, or using the QueerSpace application (the "App") and related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
2. About QueerSpace
QueerSpace is a community-driven safety and inclusivity mapping application operated by Robinsight Limited, a company registered in Aotearoa New Zealand. The Platform enables queer and trans communities to share and access information about businesses and services based on their safety, respect, competence, and inclusivity. QueerSpace is designed to help queer and trans New Zealanders find affirming spaces and make informed decisions about where to spend their time and money.
Every review on QueerSpace creates value twice: once for the next person looking for a safe space, and again as part of anonymised, aggregated trends that reveal patterns nobody has tracked before. We work with research organisations, government agencies, local councils, health boards, and advocacy groups to share these insights and support evidence-based policy change for queer and trans communities. We never share individual reviews, ratings, or identifying information outside the platform. What we publish is the bigger picture: which types of businesses and services score well, which regions have gaps, and where things are improving.
3. Eligibility
You must be at least 16 years of age to use the Platform. By using QueerSpace, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are under 16, please do not use this Platform. These Terms are governed by the laws of Aotearoa New Zealand, and you consent to the non-exclusive jurisdiction of the New Zealand courts.
4. Account Registration and Responsibility
You may create an account by:
- Using your email address and a password
- Using social authentication (e.g., Google, Apple)
- Using the Platform anonymously without creating an account
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and are responsible for all activities that occur under your account. You agree to notify QueerSpace immediately of any unauthorised use of your account. Accounts may use pseudonyms; we support anonymity as a safety measure for queer and trans users.
5. Free and Premium Services
Free Tier
All users have access to the Free Tier, which includes:
- Interactive community map of rated businesses and services
- Community reviews with Safety, Respect, Competence, Environment, and Overall Inclusivity ratings
- Search and filter functionality
- Safety alerts and warnings for specific businesses
- Healthcare provider directory
- Anonymous review submission
Safety information and core community features are always free and will never be paywalled.
Future Services
QueerSpace does not currently offer a premium tier. If we introduce paid features in the future, it will only be because they add genuine value to the community. The core platform, including safety information, community reviews, and the interactive map, will always remain free.
We may in the future invite businesses to purchase reports containing their own anonymised, aggregated review data and how it compares to similar businesses in their area. We will never sell or share any information that makes a person identifiable. Ever.
6. User-Generated Content (Reviews)
Ownership and License
You retain all ownership rights to any reviews, ratings, and comments you submit to QueerSpace ("Your Content"). By submitting Your Content to the Platform, you grant QueerSpace a non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, display, and distribute Your Content on the Platform and in connection with QueerSpace's operations. This license includes the right to use Your Content in anonymised, aggregated form to compile insights and trends about inclusivity across Aotearoa New Zealand, which may be shared with research organisations, government agencies, and advocacy groups in support of our mission. Your individual reviews and identity are never disclosed in this process.
Review Requirements
Reviews submitted to QueerSpace must:
- Be based on your genuine experience with the business or service
- Reflect your honestly held opinions and observations
- Include structured ratings across five dimensions: Safety, Respect, Competence, Environment, and Overall Inclusivity
- Provide factual, descriptive commentary to support your ratings (e.g., "The staff referred to me using slurs when I asked to be called by my correct pronouns")
7. Honest Opinion Protections
QueerSpace recognises that honest opinions about businesses based on genuine experiences are protected under New Zealand law, particularly the defamation law "honest opinion" defence. Reviews submitted to QueerSpace that reflect genuinely held opinions based on real experiences with a business or service are protected content.
If you face legal threats or cease-and-desist letters for a review you have submitted to QueerSpace, we will:
- Provide you with written support and documentation for your review's consistency with NZ defamation law
- Not remove your review based solely on a legal threat (unless ordered by a court)
- Refer you to legal resources and community support
8. Business Ratings and Responses
Community-Driven Ratings
QueerSpace ratings are entirely community-driven and based on user reviews. QueerSpace does not rate businesses, and ratings cannot be purchased, removed, or altered by any payment or arrangement. Businesses cannot pay QueerSpace for higher ratings, removal of reviews, or preferential placement. All ratings are determined solely by community feedback.
Business Response Rights
Businesses may respond to community reviews through official QueerSpace business account channels. Responses must be professional, factual, and respectful. Abusive, discriminatory, or retaliatory responses may result in suspension of the business account.
9. Prohibited Conduct
You agree not to engage in any of the following prohibited conduct on QueerSpace:
- Doxxing: Sharing or requesting personal information (addresses, phone numbers, names) intended to facilitate harassment
- Harassment: Targeted abuse, threats, or repeated unwelcome contact directed at individuals or groups
- Brigading: Coordinated campaigns to manipulate ratings, spam reviews, or overwhelm a business with fake reports
- Bad-Faith Reviews: Submitting ratings or reviews without genuine experience with a business, or for the purpose of damaging a business for non-safety reasons
- Anti-Queer or Transphobic Content: Content that demeans, harasses, or advocates discrimination against queer, trans, or rainbow communities
- Spam or Misleading Content: Repetitive, unsolicited, or deliberately false information
- Impersonation: Creating accounts or submitting content claiming to be someone else
- Attempting to Manipulate Ratings: Using bots, fake accounts, or other automated or manual methods to artificially influence business ratings
10. Content Moderation
QueerSpace uses a combination of automated and human moderation to maintain a safe, respectful community:
- AI-assisted screening: Automated tools perform a first pass to flag potentially prohibited content (spam, abuse, doxxing)
- Community moderator review: Trained community moderators review flagged content and take action based on community guidelines
- Community reporting: Users can report content they believe violates these Terms
QueerSpace reserves the right to:
- Remove content that violates these Terms or our Community Guidelines
- Suspend or terminate accounts that repeatedly violate these Terms
- Remove content in emergency situations (imminent harm, illegal activity)
QueerSpace does not pre-screen all content before publication and is not obligated to do so. However, we do respond to user reports and enforce these Terms consistently.
11. Privacy
Your use of QueerSpace is also governed by our separate Privacy Policy, which describes how we collect, use, and protect your information. By using QueerSpace, you consent to our privacy practices as described in the Privacy Policy.
Key Privacy Principles:
- We never store precise GPS coordinates or exact user locations
- Location data is aggregated at the suburb level only
- We do not use or share user data for advertising purposes
- We may share anonymised, aggregated trends with research organisations, government agencies, and advocacy groups to support policy change for queer and trans communities. Individual reviews and identifying information are never shared.
- Review locations reference business addresses, not user positions
12. Intellectual Property
QueerSpace Platform and Brand
Robinsight Limited owns all intellectual property rights in the QueerSpace platform, including the mobile app, website, brand, logo, and all underlying technology. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms.
Your Content
You retain all intellectual property rights in Your Content (reviews, ratings, comments). By submitting Your Content, you grant QueerSpace a non-exclusive, royalty-free license to use, reproduce, display, and distribute Your Content.
13. Paid Services and Billing
QueerSpace does not currently offer paid subscriptions or premium features. If paid services are introduced in the future, these Terms will be updated with at least 30 days' notice. Any paid services will be subject to clear billing, cancellation, and refund terms at that time. The core platform will always remain free.
14. Disclaimers
Community-Sourced Information
QueerSpace provides community-sourced information, not professional advice. While we strive for accuracy, reviews and ratings reflect individual community members' experiences and opinions. We do not guarantee the accuracy, completeness, or reliability of any review or rating on the Platform.
No Liability for Business Conduct
QueerSpace is not responsible for the conduct, products, services, or safety practices of any business listed on the Platform. Your interactions with businesses are at your own risk. We recommend you independently verify information about businesses before visiting or engaging with them.
"As-Is" Service
The QueerSpace Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful code.
15. Limitation of Liability
To the maximum extent permitted by the laws of Aotearoa New Zealand, Robinsight Limited and QueerSpace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid QueerSpace in the 12 months preceding the claim (or NZD $100, whichever is greater).
16. Indemnification
You agree to indemnify and hold harmless Robinsight Limited, QueerSpace, and their officers, directors, employees, and agents from any claims, damages, or costs (including reasonable legal fees) arising from:
- Your use of the Platform in violation of these Terms
- Your Content or any review you submit
- Your infringement of others' intellectual property or privacy rights
17. Termination
QueerSpace may suspend or terminate your account and access to the Platform if you:
- Violate these Terms or our Community Guidelines repeatedly
- Engage in illegal activity
- Use the Platform to harm others
You may delete your account at any time through your account settings. Upon account deletion, your profile is removed from the Platform, though your reviews may remain (this is to preserve the integrity of community feedback). If you have an active subscription, cancellation should occur through your billing settings.
18. Dispute Resolution
Good Faith Negotiation
If you have a dispute with QueerSpace, please contact us at legal@queerspace.nz to attempt resolution. We will work in good faith to resolve any disagreement.
NZ Courts
If good faith negotiation does not resolve the dispute, you agree that any legal action or proceeding shall be brought exclusively in the courts of Aotearoa New Zealand.
19. Changes to These Terms
QueerSpace may update these Terms from time to time. If we make material changes, we will notify you by email or through the App at least 30 days before the changes take effect. Your continued use of the Platform after the notice period constitutes acceptance of the updated Terms.
20. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Aotearoa New Zealand, without regard to its conflict of law principles. The exclusive jurisdiction and venue for any legal action arising from these Terms shall be the courts of Aotearoa New Zealand.
